According to Florida Statute 316.193, a person has committed the criminal act of DUI causing serious bodily injury when they are driving a vehicle while impaired and they cause or in any way contribute to someone else’s serious personal injury.
To be convicted of DUI causing serious bodily injury, the prosecution must prove that:
- The defendant was driving or in physical control of a motor vehicle
- The defendant was under the influence of alcohol and his or her normal faculties were impaired while driving the motor vehicle
- The defendant had a BAC of 0.08 or above
